Name Change/Name Conformity

A new law went into effect August 17, 2021, establishing a procedure for a person to conform the name on all legal documents. This law eliminates the requirement to publish the application and the requirement for a hearing on any Name Change unless it is for a minor or a hearing is deemed necessary by the Judge or Magistrate.

Name Conformity” allows non clerical errors to be corrected on legal documents so that all documents match; for example; a person would use Name Conformity if the name on any legal document is Angelica but the name on all other documents is Angela. This may be necessary to obtain travel compliant documents, including a new driver’s license.

A Name change, changes a person’s legal name while a name conformity does not change a person’s current legal name, only changes legal documents to reflect the correct legal name.

To correct a clerical error, for example Angelica was misspelled Angelici on a birth certificate, please refer to the Birth Registration/Correction forms on the Summit County Probate website.

Those wishing to have conforming documents can apply by following the instructions on the Summit County Probate Court website by filling an application and a filing fee.   A person applying for name change/name conformity must show that they have lived in Summit County for 60 days preceding the application.

 

CAREFULLY READ THE FOLLOWING INSTRUCTIONS TO SAVE YOU TIME

 

Requirements for Both a Name Change or a Name Conformity:

An Applicant for a Name Change of an Adult or Minor or Name Conformity must live in Summit County for no less than sixty (60) days immediately prior to filing.

Adult & Minor Name Change:  The Applicant or an attorney, should prepare the correct documents and file them in the Court with the filing fee.  Once the documents have been reviewed and approved by the Court, the Judgment Order will be sent to the Applicant. It is up to the Judge or Magistrate to decide if a hearing is held and if so, you will be notified of the hearing date.

Minor Name Change only:  A parent or guardian of a minor child may apply to change the name of a child.  The parent(s) who is not the Applicant, must either consent to the change by signing a form or will be served by the court with notice of a hearing. If the parent is deceased, a photocopy of that parent’s death certificate must be provided. If a parent(s) whereabouts are unknown, see Affidavit Form CN.1, a hearing will be set. If consents from both parents are signed, the Judge or Magistrate will decide if a hearing is necessary and you will be notified of the hearing date. If no hearing is held, the applicant will receive the Judgment Order granting the change of name by mail.

Adult & Minor Name Conformity: The Applicant or an attorney should prepare the correct documents listed below and file them in the Court with the filing fee.  Once the documents have been reviewed and approved by the Court, the Judgment Order will be sent to the Applicant. It is up to the Judge or Magistrate to decide if a hearing is held and you will be notified of the hearing date. You do not need to publish with the Akron Legal News.

Minor Name Conformity Only: A parent or a guardian may file an application to ask that a child’s legal documents be changed to conform.  The parent(s) who is not the Applicant, must either sign a consent or be served by the court with a notice of a hearing. If a parent is deceased, a photocopy of that parent’s death certificate must be provided. If a parent’s whereabouts are unknown, see Affidavit Form CN.1 and Form CN.6.  If consents are signed by both parents, it is up to the Judge or Magistrate to decide if a hearing is held and you will be notified of the hearing date. If no hearing is held the Applicant will receive the Judgment Order granting the name conformity by mail.

 

DOCUMENTS NEEDED FOR FILING: 

  • Application (Form 21.0 – Adult Name Change, Form 21.2 – Minor Name Change, or Form CN.3Name Conformity)
  • Photocopies of the following documents to be submitted with the application:

Birth Certificate

Driver’s License/State ID Card

Social Security Card

Passport (if any)

Any identity document showing the current legal name

  • Affidavit in Support of Application to Conform or Change Name of an Adult or Minor Form CN.6
  • MINOR ONLY:  Waiver and Consent of Notice of Hearing and Consent to Conform Legal Name of Minor Form CN.4

Both parents of the minor must sign this waiver to dispense with a hearing on the application.

  • Affidavit Of Proof Of Due Diligence To Locate Parent In A Minor Name Change Form CN.1, If both parents have not waived.

The Court is required to verify an unknown address. If the Court has to search for the address, and locates an address, there will be an additional charge to the applicant.

 

The court reserves the right to require additional documents to be submitted to support the Application and to hold a formal hearing.

  • Filing fee is $125.00.
