Instructions for Filing Real Estate Transfer Only

A Real Estate Transfer Only may be filed if:

  • Six months has passed since the date of death
  • The sole probate asset of the decedent’s estate is real estate
  • The decedent was not subject to Medicaid Estate Recovery

What I need when I file:

  • The original Last Will and Testament (if one exists)
  • Receipt of a paid funeral bill.
  • The date of death value of real property as found in Summit County Fiscal Office property records and or original appraisal.
  • An accurate legal description and or copy of the deed
  • A Copy of the Death Certificate.

 

File these forms (if there is an original Will):

  • Form 2.0 – Application to Probate Will
  • Form 2.1 – Waiver of Notice of Probate of Will
  • Form 2.4 – Certificate of Service of Notice of Probate of Will
  • Form 1.0 – Surviving Spouse, Next of Kin
  • Form ER.11 – Filing Information Real Estate Only
  • Form 12.0 – Application for Certificate of Transfer
  • Form 12.1 – Certificate of Transfer

 

File these forms (if there is not an original Will):

  • Form 1.0 – Surviving Spouse, Next of Kin
  • Form ER.11 – Filing Information Real Estate Only
  • Form 12.0 – Application for Certificate of Transfer
  • Form 12.1 – Certificate of Transfer

 

Filing Fee:

  • The filing fee is $100.00
  • If you use a credit card, a 3% charge will be added.
  • Transferring real estate may require an additional fee.
